Juror Issues in the Karen Read Retrial? Today was a bumpy start to Day 20 as each juror came into court to speak to the judge about an ‘issue’. Court was completely cleared for this so only the lawyers, Karen Read and court staff were present. This happened on the record but sidebar conversations are sealed so we won’t know exactly what the issue was. However, we have some clues from Friday and from what the court said and did when court resumed today. No juror was removed, but seats were changed around. The Jury has been admonished by the court once for talking and court observers have noted jurors chatting with each other during sidebars and other moments of trial. Oh Boy!

New Ruling In The Karen Read Retrial. The Court is allowing the information contained in the prosecutions new report from May 8, 2025. The prosecution contends this information is not new, but a response to the defense expert. The defense disagrees. Now I just want to see the reports because the arguments are so vastly different it’s hard to understand what the judge is looking at in making this ruling. When this expert testifies I’m very interested in how this comes in and if the opinion changed.

Karen Read’s Lawyers are pissed. The Defense argued after the jury left today that the Commonwealths experts new report should be excluded. This report ‘updates’ a critical time correlation to Karen Reads vehicle triggering events. The Commonwealth explained the shift was due to an update in which clock time is accurate and properly correlating Karen Reads SUV time to John O’Keefes phone time. Prosecutors argue this rebuts a defense experts time regarding the SUV. The Defense argues that its late discovery and should be excluded. The Court hasn’t ruled but did ask the defense for alternate remedies to exclusion, citing that she is allowing ARCCA in even though the prosecution argued they should be excluded for late discovery. We will be talking about this more tomorrow, and in my case brief for today dropping on The Emily Show podcast.
